Claims are now being accepted for an $8.25 million class action settlement involving allegations the Wright Profemur Hip Implant System was defective.
If you are a Canadian resident who was implanted with the Wright Profemur Hip Implant System after February 2001 and you experienced a hip implant fracture that required revision surgery, you may be entitled to compensation from a Wright Profemur hip implant class action lawsuit settlement.
According to the hip implant class action lawsuit, the Wright Profemur hip implant was prone to fail prematurely, requiring patients to undergo hip revision surgery. Some patients reportedly suffered significant hip revision surgery complications such as stroke, blood clot, infection, or permanent nerve damage.
The Wright Profemur hip implant class action lawsuit was first certified in 2014. The certification order was amended on April 30, 2019.
The Wright hip implant defendants do not admit liability but agreed to pay up to $8.25 million to settle the hip implant failure class action lawsuit and avoid the burden and expense of ongoing litigation.
The actual amount the Wright hip implant defendants will pay depends on the total number of approved claims. According to the hip implant settlement documents, the distribution of payments to approved claimants will be made based on the compensation protocol outlined in the deal, and will be subject to pro rata allocation.
For example, if there are more than 60 approved claims, the Wright defendants must pay the maximum $8.25 million to settle the class action lawsuit. If there are 35 approved claims, the settlement payment will be $5.425 million.
The settlement fund will also be used to pay provincial and territorial health insurers for recoverable costs of services for approved claimants.
The Wright Profemur hip implant settlement was approved by the Supreme Court of Nova Scotia on June 26, 2020. Justice Joshua Arnold determined the settlement is “fair, reasonable and in the best interest of Class Members based on an analysis of the facts and applicable law, taking into account the extensive burdens and expense of litigation, including the risks and uncertainties associated with the protracted trials and appeals, as well as the fair, cost-effective and assured method provided in this Settlement Agreement of resolving the claims of Class Members.”
The deadline to opt out of or object to the Wright Profemur hip implant class action settlement passed on Dec. 31, 2015.
Who’s Eligible
Class Members of the Wright hip implant settlement include Canadian residents who were implanted with a Wright Profemur Hip Implant System after February 2001 and suffered a hip implant fracture requiring a revision surgery.
NOTE: Legal representatives of eligible Class Members who are under a legal disability may file a claim on their behalf.

The amount each claimant is eligible to receive depends on their specific situation, including how many revision surgeries were required and any complications they suffered.
Proof of Purchase
Claimants must provide information about their Wright Profemur hip implant surgery, including the location of the hip implant(s), implant date, revision date, name of hospital at which the procedures were performed, and the name of the surgeon who completed the hip implant and revision surgery. Identification stickers and operative report(s) for the hip implant must also be submitted.
If you have had more than one revision surgery due to a Wright Profemur hip implant failure, you must submit additional hospital records relating to that surgery (or surgeries).
If you suffered hip implant complication following a revision surgery, such as stroke, blood clot, infection or permanent nerve damage, you should provide the date on which you experienced the complication.
