Audi Airbag Class Action Lawsuit Overview:

  • Why: The plaintiff alleges an ongoing defect in her Audi vehicleโ€™s airbag system, which could put her passengers in danger.
  • Who: An Audi driver lodged a class action complaint against Audi Canada.
  • Where: The class action lawsuit was filed in Quebec superior court.

An Audi driver filed a class action lawsuit against Audi Canada for a supposedly defective passenger occupant detection system that could prevent the passenger airbag from deploying.

The plaintiff leased a new Audi A3 in 2020. Months later, the airbag warning light on the vehicleโ€™s dashboard turned on to indicate that the front passenger airbag was deactivated. A constant beeping sound accompanied the warning light.ย 

The plaintiff contacted an Audi dealer to get the problem fixed. She was told Audi was looking into the problem and that in the meantime, “it would be safer not to have passengers in that seat in case of an accident and airbag malfunction.”

The plaintiff has tried to get a loaner vehicle and financial compensation from Audi since she was paying for a vehicle, the Audi A3, that wasnโ€™t fully functional. However, the plaintiff claims she has been waiting seven months for a remedy from Audi.

The proposed class includes anyone who purchased or leased the following vehicles:ย 

  • 2016-2020 Audi A3
  • 2016-2018 Audi A3 E-TRON
  • 2018-2020 Audi RS3
  • 2016-2020 Audi S3

Defective Airbags Subject of Recall

The class vehicles were already the subjects of Transport Canada Recall 2021-169 for the same issue of defective passenger occupant detection systems (PODS).

The issue was detailed in a recall notice which the plaintiff received. In the notice, Audi acknowledged that the PODS malfunction may switch off the passenger airbag even if there was a passenger in the front seat. However, the warning light would still activate, as it did inthe plaintiffโ€™s vehicle.ย 

The plaintiff was told that when the airbag warnings stop, the passenger airbag is active again.ย

    Iโ€™ve been experiencing the same issues for over two years with my leased A3. Audi Canada told me not to use the front passenger seat, which is clearly an unreasonable solution, and are unwilling to do anything else blaming the shortage of parts. Iโ€™ve asked about switching to a different Audi vehicle and they refused.

      Same was so frustrating. After the first recal to fix this issue actually made it worse.
