The Canadian government has agreed to a class action lawsuit settlement to resolve claims that the Phoenix pay system failed to pay government employees what they were owed.
The Phoenix pay system settlement benefits individuals who were employed by the Government of Canada in certain departments between Feb. 24, 2016, and March 31, 2020, and who experienced difficulties receiving their pay.
The Phoenix pay system allegedly failed to pay government workers what they were owed, the class action lawsuit contends. The Phoenix pay system class action lawsuit against the Canadian government alleged the Phoenix pay system was “unreasonably dangerous” and that the government was aware of the risks but decided to implement the system regardless in violation of its fiduciary duties.
The Phoenix pay system was implemented for government employees in 2016.
The Canadian government hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve these allegations.
Under the terms of the Phoenix pay system settlement, class members can receive a cash payment based on their eligibility for each fiscal year. Class members can receive a maximum of $350 for the 2016-2017 fiscal year, up to $175 for the 2017-2018 fiscal year, a maximum of $175 for the 2018-2019 fiscal year and up to $175 for the 2019-2020 fiscal year.
Payments received from the Phoenix settlement will not be considered income and therefore are not subject to deductions for taxes, CPP contributions and EI premiums. However, these payments may be used to reduce any amounts claimants owe to the Government of Canada.
The deadline for exclusion and objection is Sept. 22, 2023.
The final approval hearing for the Phoenix pay system class action lawsuit settlement is scheduled for Oct. 3, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by Oct. 24, 2025.
