Lowe’s has agreed to a class action lawsuit settlement to resolve claims it failed to honor lower prices in a website pricing error.

The settlement benefits Canadian consumers who purchased certain items from several Lowe’s websites — www.lowes.ca, www.rona.ca or www.renodepot.com — on May 1, 2021. Items covered by the settlement are:

  • Bosch 11321EVS Demolition Hammer (SKU 330009246)
  • Bosch Bulldog Rotary Hammer (SKU 330609676)
  • Bosch Electric High Power Washer (SKU 330658625)
  • Bosch StarlockPlus(R) Oscillating Multi-Tool Kit Corded (SKU 330658628)
  • Bosch Blaze Outdoor Connected Laser Measure with Camera (SKU 330746850)

Lowe’s is a chain hardware store with locations around the world. Competing with companies such as Home Depot and Menards, Lowe’s provides products for home improvement, building, gardening, and more.

But customers may have overpaid for their products when purchased from Lowe’s online due to a pricing error.

The plaintiff in a Lowe’s pricing class action lawsuit says that he tried to purchase two items on the company’s Canadian website and was charged $39.99 and $99.99, respectively. 

However, after selling items at these prices, Lowe’s allegedly canceled the plaintiff’s order. The next day, according to the class action lawsuit, Lowe’s advertised the same items at $179.99 and $949.00, respectively.

The plaintiff contends that, even if Lowe’s listed the items at a lower price in error, the store should have honored the lower prices at which the items were purchased. 

Lowe’s hasn’t admitted any wrongdoing but agreed to resolve these allegations with a class action settlement.

Under the terms of the settlement, Class Members can receive a credit for the price difference they paid for items on the Lowe’s website. 

According to the settlement website, each Class Member will receive a credit in the amount of the price difference for each item bearing the covered product codes the Class Member ordered on the websites on May 1, 2021, up to a maximum of one item per Class Member for each product code, regardless of the number of items ordered that bore a particular code.

Each Class Member may receive between $140 and $850 in credits per item. Exact payments will vary.

Credits from the settlement do not expire and cannot be converted, refunded, or transferred.

The credits will be emailed to Class Members within 90 days after the Court’s approval order becomes final.

The settlement was authorized by the Superior Court of Quebec on Feb. 28, 2022. 

The deadline for Class Members to opt out of the settlement is April 25, 2022.

A final approval hearing for the settlement is scheduled for April 26, 2022.
