Canada residents who were employed by Russell Security in Ontario may be eligible to receive compensation in the form of a payment as the result of a $725,000 class action lawsuit settlement.
Settlement Class Members include all security guards employed by Russell Security in Ontario between Jan. 1, 2017, and Aug. 13, 2021.
In their class action lawsuit, the plaintiffs allege Russell Security did not adequately pay them for pre-shift, off-the-clock time. According to Plaintiffs, the company directed them to get to work 15 minutes before their shift and start to work before actually clocking in.
Russell Security denies any wrongdoing, but has agreed to the terms of the proposed settlement after attending mediation with the plaintiffs.
While Russell Security has been successful on its own, it was recently acquired by Securiguard, Canada’s leading provider of corporate security, according to the company website.
Individuals whose name is already on the list of Class Members in this class action settlement will not need to take action to ensure they receive a cheque.
However, they should verify that the settlement administrator has their updated address and contact information.
Those who are not on the list of Class Members may need to provide documentation to the administrator in order to be included.
Eligible Class Members will receive an average expected payment of $151.
This payment amount is subject to change based on the number of weeks worked during the Class Period, the number of Class Members, and the costs of other lawsuit-related fees.
On top of monetary relief, Russell Security has also updated its security guard handbook to clarify expectations in the future.
Class Members who do not wish to remain in the Class and want to keep their right to seek out a future claim must opt out of the Class by Dec. 17, 2021.
Class Members who don’t agree with the terms of the proposed settlement have a right to object to the terms by Dec. 6, 2021.
A final hearing in the Russell Security settlement is scheduled to take place Dec. 20, 2021.
