British Columbia Insurance Class Action Lawsuit Overview:

  • Who: Two accident victims filed a class action lawsuit against British Columbia and its public insurer, Insurance Corporation of BC (ICBC).
  • Why: The plaintiffs allege ICBC reimbursed the province for medical fees with money that came from accident victims. 
  • Where: The class action lawsuit was filed in British Columbia.

British Columbia and the insurer ICBC face a class action lawsuit that alleges ICBC illegally reimbursed the province for medical fees that should have been covered under the Medical Services Plan (MSP) with money from accident victims.  

The lead plaintiffs are Robert Rorison and Brayden Methot. Methot was left partially paralyzed after he was in an accident near Kamloops in 2014; ICBC owes him $3,700, according to the lawsuit.

Rorison and Methot allege ICBC took money from accident victims’ benefits, such as Methot’s, denying them their full coverage, to make those wrongful payments to BC. 

ICBC Shorted Accident Victims, According to Class Action Lawsuit

The class action lawsuit is argued on behalf of an Accident Victim Class, which includes people who “suffered catastrophic injuries in motor vehicle accidents” and saw reduced medical and rehabilitation benefits as a result of ICBC’s payments to BC. ICBC policies stated those same victims should have received full benefits, according to court documents. 

There are 275 people that could be included in the Accident Victim Class and who have been offered compensation by ICBC, according to court filings by ICBC. But the plaintiffs’ counsel argues that ICBC was taking money from everyone’s accounts, making the total much higher. It was the victims who could not afford to lose such benefits that took the hardest hit.

The class action lawsuit previously contained a Ratepayer Class, which would seek relief for all buyers of compulsory vehicle insurance who faced “wrongfully increased insurance costs” from ICBC. This class was thrown out by the court.
