Groupe Adonis Inc. has agreed to a $775,000 class action settlement resolving claims it sold products contaminated with hepatitis A.
In spring 2018, the supermarket company recalled several products over potential hepatitis A contamination:
- Frozen strawberries from Egypt, Montana brand, 1 kg format, sold in all establishments of the Adonis banner between Jan. 15, 2018, and April 20, 2018, and bearing code 6222000401487
- “Adonis Juice” bottled with strawberries and bananas, 1 L and 500 ml formats, sold in all Adonis-branded establishments between Jan. 15, 2018, and April 13, 2018
- Bottled “Strawberry Sweetness” smoothies, 1 L and 500 ml formats, sold in all Adonis-branded establishments from Jan. 15, 2018, to April 13, 2018
- The “Adonis”, “Monsieur Twister”, and “Saveur d’été” cocktails served in plastic glasses, large and medium sizes, sold in all Adonis-branded establishments between Jan. 15, 2018, and April 13, 2018
The proposed Class includes anyone in Quebec who contracted hepatitis A by consuming the allegedly contaminated recalled products; who was vaccinated against hepatitis A following their consumption of the recalled products; who purchased the recalled products between Jan. 15 and April 20, 2018; and/or who is the successor, beneficiary, heir, family member, or dependent of a person who contracted hepatitis A by consuming one of the recalled products.
Groupe Adonis has not admitted any wrongdoing.
The Court will decide whether to approve the Groupe Adonis settlement at a June hearing.
If the settlement is approved, a distribution protocol will be established, and Class Members will be able to file a claim.
The proposed distribution plan provides compensation depending on the duration of the Class Member’s illness and hospitalization.
Class Members will not be able to make both an illness claim and a vaccination claim.
An approval hearing is scheduled to take place June 18, 2021.
