Bell Canada has settled a class action lawsuit in which Quebec consumers accused the telecom giant of falsely advertising its FIBE TV and FIBE Internet services.
The $2 million settlement puts an end to consumers’ claims that the company did not always provide its services through fibre optics as it allegedly said it did, although Bell has not admitted guilt in the case.
Consumers who subscribed to Bell’s FIBE TV or Internet are eligible to $8 each, plus tax, which will be distributed by way of a one-time price reduction on their monthly invoice.
To be eligible for the credit, Bell subscribers must have subscribed to Bell’s FIBETM Internet or television services between May 1, 2012 and March 30, 2017; be connected to Bell’s network through a fibre-to-the-neighbourhood connection (FTTN); and remain subscribed to Bell’s FIBETM Internet or television services.
As part of the settlement, class counsel will receive $600,000.00 plus taxes, and other costs and expenses totaling more than $100,000.00, subject to Court approval.
The class action lawsuit was first launched in Quebec in March 2017 by lead Plaintiff Shay Abicidan, who alleged that the company misled consumers into believing they had access to a fully fibre-optic network.
“The Plaintiff alleged that Bell Canada misled consumers by using the term Fibe and/or fibre optics when offering services that were, in fact, hybrid (i.e. composed of fibre optics and copper), in violation of Quebec’s Consumer Protection Act,” a website for the class action lawsuit reads.
“Bell Canada has always denied these allegations and contested them in Court. The parties have agreed to settle the class action without any admission of any kind.”
Bell has continued to deny any wrongdoing or liability in connection to the class action lawsuit and says it never concealed the fact that, in some locations, its FIBETM Internet and television services are provided through fibre optics to the neighbourhood (FTTN connection) as opposed to fibre optics to the home (FTTH connection).
