Mercedes-Benz has reached a $243 million settlement with diesel vehicle owners in Canada, ending a class action lawsuit that alleged the company hid its lack of compliance with the countryโs emission laws.
Law firm Koskie Minsky LLP says Daimler AG and North American Mercedes-Benz subsidiaries have agreed to pay the $243 million settlement to the 83,000 class members who own Mercedes-Benz BlueTEC vehicles made between 2009 and 2016.
The Canadian Press reports that the automaker will repair qualifying vehicles to provide cleaner emissions that comply with Canadian standards as part of the settlement, and that class members whose cars are repaired will be eligible to receive up to $2,925 in cash payments.
Class members are also entitled to other potential payments and a buyback option in some circumstances, the outlet reports.
Vehicle Owners Claimed Vehicles Emit Toxic Chemicals At Much Higher Levels When Temperatures Are Below 10โ
The vehicle owners claimed in the class action lawsuit that their vehicles emit toxic chemicals at much higher levels at temperatures below 10 degrees Celsius.
An approval hearing for the settlement has been set for Feb. 9, 2022.
In March, Mercedes-Benz agreed to pay a maximum of $726 million in a settlement with vehicle owners in the U.S. who alleged a similar emissions fraud scheme. Plaintiffs in the case said that certain Mercedes-Benz BlueTEC vehicles were equipped with emission control systems that caused them to emit more nitrogen oxides than consumers expect and more than what is permitted under state and federal law.
Current owners and lessees were eligible to receive up to $3,290 from the Mercedes BlueTEC settlement, plus about $300 from the Bosch settlement (which was $63.3 million), plus a possible additional payment, if no former owner or lessee submits a valid claim for the same vehicle.

I own a 2013 ML 350 BlueTech that emits strong toxic/organic smell. At times the smell is so strong that I have to drive with the windows down. The dealership has performed in-depth inspections and cleaning several times but the smell persists. I am still waiting for the recalled part to be installed in my vehicle. It is embarrassing to come out of your car smelling like organic garbage landfill
