Navistar agreed to a $14.5 million class action lawsuit settlement to resolve claims that its trucks were equipped with defective emissions systems.
The settlement benefits Canadian owners and lessees of 2011 to 2014 Navistar Paystar, Workstar, Transtar, 9900i, Lonestar and Prostar vehicles equipped with MaxxForce 11-, 13- or 15-litre engines certified to comply with 2010 EPA standards.
Plaintiffs in the class action lawsuit claim that Navistar equipped its vehicles with defective Advanced Exhaust Gas Recirculation (EGR) emission systems that failed unexpectedly. These systems allegedly required expensive repairs or replacements, causing financial damages to consumers.
Navistar is a heavy-duty truck company that sells several brands of specialized trucks for various industries.
Navistar hasnโt admitted any wrongdoing but agreed to pay $14.5 million to resolve the emissions class action lawsuit. The settlement fund includes $13.775 million in cash payments and $725,000 in rebates.
Under the terms of the settlement, class members a cash payment, a rebate or reimbursement for certain repairs and replacements.
Class members can receive cash payments of up to $2,500 from the settlement. Payments will vary depending on the number of months each claimant owned or leased their vehicle and what model year their vehicle was. The settlement provides cash payments of $19.38 per month for 2011 vehicles, $21.37 per month for 2012 vehicles, $23.81 per month for 2013 vehicles and $26.88 per month for 2014 vehicles.
Class members who donโt wish to receive a cash payment may instead choose to receive a rebate of up to $10,000 toward the purchase of a new Navistar Class 8 heavy-duty truck. Like the cash option, rebate amounts will vary depending on the number of months each claimant owned or leased their vehicle. The settlement provides rebates of $77.52 per month for 2011 vehicles, $85.47 per month for 2012 vehicles, $95.24 per month for 2013 vehicles and $107.53 per month for 2014 vehicles.
Class members who experienced covered events or costs related to their vehicle have a third option for settlement benefits, up to $15,000 in reimbursement. This reimbursement compensates consumers for service events for repair or replacement related to their vehiclesโ EGR cooler or EGR valve โ the primary components โ or service events for repair or replacement of the lambda sensor, oxygen sensor, oil centrifuge, intake and exhaust valve/seat, valve bridge, cylinder head, turbochargers, diesel particulate filter and DOC/pre-DOC components, in addition to any total engine replacements or rebuilds caused by turbocharger failure, that occurs within 30 days of a service event for repair or replacement of a primary component. The amount of potential compensation depends on the number of kilometres accumulated on the vehicle, the covered event and whether it meets the requirement of certain covered costs.
Class members can also claim reimbursement for related costs such as repair costs, rental costs, lost revenue, travel expenses, towing costs, employee wages, permits, loading costs and more.
Class members may only claim one of the three possible settlement benefits.
Payment amounts may be increased or reduced proportionately depending on the number of claims filed.
The deadline for exclusion and objection was Nov. 17, 2023.
The final approval hearing for the settlement was held on Nov. 30, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by Aug. 19, 2024.
