Class action claims B.C. goverment's COVID-19 response excessive and based on flawed science.

The Canadian Society for the Advancement of Science in Public Policy says British Columbia’s response to the coronavirus was too much and it caused an excessive amount of public harm. The organization filed a class action lawsuit saying B.C. overreached its authority.

The lead plaintiff, the Canadian Society for the Advancement of Science in Public Policy (Society), says that its purpose is to advocate for the use of science in the formation of public policy. To that end, it claims that the B.C. government and Provincial Health Officer have based the province’s COVID-19 response on a misunderstanding of statistical data.

“In its response to the COVID-19 virus, the government of British Columbia has invoked extraordinary executive powers predicated on unsubstantiated scientific and legal grounds with catastrophic consequences for British Columbians,” alleges the class action lawsuit.

British Columbia’s response to COVID-19 began on March 18, 2020, with a declaration of a “state of emergency” by the provincial government. The declaration was made under the Emergency Program Act (EPA), allowing the government to exercise “sweeping statutory powers,” claims the Society.

“Despite the relatively low number of persons infected by COVID-19 in British Columbia, the Public Health Officer failed to provide notice that the emergency had passed and the Lieutenant Governor in Council continued to extend the emergency declaration under EPA,” contends the class action lawsuit.

The Society points out that between January and March of 2020, three deaths were attributed to COVID-19. The plaintiff acknowledges that the death rate increased in the following months, but mainly affected those in underfunded and staffed care home facilities.

“While hospitals prepared for an influx of COVID-19 patients, many medical procedures and operations were cancelled under the Provincial Government’s directives,” notes the class action lawsuit. “However, the high number of intensive care COVID-19 patients did not materialize. Most people infected with COVID-19 experienced mild to moderate influenza-like symptoms that abated quickly.”

The Society also points out that on-site and in person teaching activities have since resumed; however, the B.C. government has maintained a state of emergency.

“British Columbia is currently in the longest state of emergency in provincial history,” asserts the lawsuit.

The Society accuses the government of misrepresenting the fatality rate of COVID-19 to maintain this status. Further, health officials are allegedly using inaccurate test results that skew the infection rate higher. In fact, the tests themselves are inaccurate having registered false-positive COVID-19 results for a goat, a kiwi, and papaya, says the Society.

The result has been “excessive public alarm” with harmful effects, including an increase in mental illness, suicide, loss of employment, bankruptcies, and other financial consequences, increases in domestic violence, divorce rates, and fewer services to low income and homeless people.

“Meanwhile the Provincial Government, the Provincial Health Officer, and her staff continue to enjoy economic security through salaries, other benefits, and pensions,” asserts the lawsuit. “All government salaries, other benefits, and pensions are at public expense and far less subject to market conditions than the millions of British Columbians’ lack of economic security caused by the continued state of ‘emergency’.”

The proposed class action lawsuit seeks to represent B.C. residents and businesses who have suffered personal injuries or losses since March 17, 2020, due to the province’s response to the coronavirus pandemic.

    Please help me. I sat by my sons bedside for three months as a hospital in downtown bc had him ventilated, paralyzed and sedated. He was obviously in extreme pain and they did nothing. They said he was end of life and cut off his food for five days and finally gave it back to him after begging them. He started moving and talking then mcfd said the police were closing investigation if they couldn’t get a statement from him and I said “so what you get away with murder then?” Social worker shrugged and just made hmm haw noises. I was not given a single consistent answer as to why he was there, there is no admission report, I keep getting ignored. I went through all the appropriate channels to be faced with continual public servants fleeing from accountability. Please help. My son died in hospital February 5th 2022. 3 days after his 18th birthday. One doctor tried to make him a Covid case and while in critical care against a letter I had written they had administered him a Covid shot.

    i would like my name added to this list. the mental strain of being isolated, the lack of employment, and being denied benefits.the depression and fear have been awful. never mind now i have had a bad reaction to the vaccine ,ive been outright lied to.

    The elected democratic government and its leaders are public servants not dictators. Peoples livelihood, education, small business are systematically destroyed. This is worst that slavery history has ever witnessed.

    Dr. Bonnie Henry has to take sole responsibility for all the physical and mental trauma she had induced upon people of BC whether it is intentional or negligence at this point of time I am deeply saddened with the mess BC government has made which is irreversible, and I am concerned parent for our children and future generations to come.

    People of BC deserve justice and due to tyranny of BC government and health officer reparation’s should be paid

    Overreach yes, and also negligence. Why was there no effort at any level to develop a treatment protocol for patients suffering from Covid-19 before they reached the point of hospitalization? The few doctors who took matters into their own hands and actually came up with treatment plans were sidelined and ridiculed, their research scrubbed off of social media sites. The only thing government concerned themselves with was the development of a vaccine, while drugs that have been used safely for decades were given no consideration, despite their proven efficacy. If they were so concerned about saving lives, why did they not think to focus on treating patients before it was too late? Also, has Dr. Henry ever treated a Covid-19 patient? Not likely. I deeply respect all the doctors who have courageously voiced their concerns and opinions and have suffered the consequences because of it. Since when is there no room for debate in the field of medicine? What a complete disgrace.

    Please sign me up. Anytime there’s a threat to people’s human rights and freedom from a government, people must stand up and fight for their rights. The intimidating discourse of the media like the Times Columnist is very concerning. In my opinion, their publications are creating an us versus them mentality that has serious hate crimes consequences. My family has been divided in this narrative and I live in fear of people finding out that am not double vaccinated. I’m afraid for my kids because we’re becoming a minority in this scamdemia.

    If ever there CES a time where a suit is filed against the government for coercion, I’d appreciate taking part in this. I fear today that my rights will be overlooked due to the upcoming orders. Further, my ability to work and provide for myself is very likely to be affected. Although it wouldn’t be immediate, homelessness is likely inevitable.

      I agree! How can we stop this! The people need to come together. We are loosing freedoms. No government should be able to force an experimental drug.

    I have lost the ability to work because of depression. While I am a senior I need to work to pay for prescriptions and other help. Many think this is an aberration but I have been neglected by my family; when I go to get groceries I get negative remarks and stares for being medically exempt and not wearing a mask, I have heart disease and cannot get in to see a doctor. I have run out of prescriptions and cannot get them refilled because those in the nearest clinic are on holiday. I have spent days on the phone trying to find someone to renew my prescription… with no luck.
    We are giving away so much money to other countries and one doctor told me he was making $74K a year with no benefits. No wonder there are no doctors available. I cannot walk more than 20 – 30 feet without being out of breath.
    I cannot handle any more ‘junk’ information about Covid and I cannot handle any more people trying to intimidate me.
    I am a senior and cannot go out by myself in case I fall. If I qualify for your class action suit, then put me down.

    A public health official came to a police science class I had prior to 2011 and spoke about this exact scenario but trying to end the common flu and locking the world down like this until a vaccine could be made. I’ve been crying foul ever since but I’m just some crazy conspiracy theorist. This shit runs deep. It’s evil. And it was planned. Not one doubt in my mind…this was planned years in advance.

    I now cry every day because the canada post office refuses to meet me at the door or respect my mask exemption and is currently holding a package of mine. I can let someone else pick it up but I choose to have no friends. My 4 year old has bad cavities and her face was starting to swell until i decided to deal with it myself because no dentist will see her because i can’t wear a mask, i am now my family dentist. Anyone that enforced this should be convicted of crimes against humanity and locked up until the end of time !!!!!
