The University of New Brunswick (UNB) hasn’t done enough to protect its students from a psychiatrist accused of sexual assault, according to a new class action lawsuit.
Plaintiff Morgan Jean Wilcox filed the class action application Monday, CBC reported, naming both Dr. Manoj Bhargava, who worked part time at the UNB Student Health Centre, and the university.
Bhargava was suspended by the College of Physicians and Surgeons last year after the college received at least five misconduct complaints against him. UNB college registrar Dr. Ed Schollenberg told CBC that since the suspension in November, the college has received a total of 18 sexual assault complaints against him.
Wilcox’s lawyer, Erika Hachey, at Moss Hachey Law, told CBC the lawsuit is being brought against Bhargava for sexual assault of students who attended the university.
It is also being brought against UNB “for the systemic failures to protect their students from Dr. Bhargava and his behaviour.”
Hachey said complaints about Bhargava were brought to the university on multiple occasions, with each of the complainants bringing “almost identical” allegations.
The statement of claim reportedly alleges the psychiatrist prescribed medication he said could affect heart rate and blood pressure. He would then ask for items of underwear to be removed and use “non-consensual sexual contact” to take heart rate and blood pressure measurements.
Wilcox was a recent victim of Bhargava who called the law firm wanting to take action, offering to represent a Class of students who were sexually assaulted, Hachey said.
The firm is currently seeking certification of the Class.
The University of New Brunswick told CBC it recently involved police. The allegations against Bhargava have not been heard or proven in court.
