Patients and surviving family members can benefit from a $4.06 million Cook IVC filter settlement if they were injured by the allegedly defective medical devices.

The settlement benefits Canadian residents implanted with the Gunther Tulip Vena Cava Filter Set, the Cook Celect Vena Cava Filter Set or the Cook Celect Platinum Vena Cava Filter Set before Jan. 8, 2020.

The settlement also benefits family members of the patients described above.

According to the class action lawsuit, Cook failed to properly warn patients and doctors about the risks associated with its inferior vena cava (IVC) filters. These medical devices were allegedly prone to fractures which could lead to pain, serious injuries or death.

Cook Medical is a medical technology company that sells catheters, stents, IVC filters and other medical devices.

Cook hasnโ€™t admitted any wrongdoing but agreed to pay $4.06 million to resolve the class action lawsuit.

Under the terms of the settlement, class members can receive up to $54,000 for a qualifying fracture, up to $81,000 for a qualifying death and up to $169,500 for a qualifying open surgery. Class members must support their claims with medical records and other documentation. Compensation for each injury category may be reduced on a pro rata basis if the claims filed exceed the total settlement fund.

The deadline for objection was May 3, 2024.

The final approval hearing for the settlement was held on May 17, 2024.

To receive Cook IVC filter settlement benefits, class members must submit a valid claim form by Nov. 11, 2024.

Canadian residents implanted with the Gunther Tulip Vena Cava Filter Set, the Cook Celect Vena Cava Filter Set or the Cook Celect Platinum Vena Cava Filter Set before Jan. 8, 2020 and their family members.
