Several event ticket distributors, including Live Nation and Ticketmaster, are facing a proposed class action lawsuit filed by a Quebec woman who claims that the companies refused to refund ticket holders for rescheduled and canceled events.

Lead plaintiff, Janie DesJardins, alleges in her complaint that a number of ticket distributors who run “fan to fan resale” tickets and refuse refund requests for canceled or rescheduled events from those who purchase tickets through these programs violate the terms of their contracts with the purchasers. This practice allegedly affects tickets sold within the province of Quebec, as well as for events held around the world.

DesJardins says she purchased tickets to a Francis Cabrel concert in April of 2019 from the website ticketscenter.com. The tickets were sold through a resale program, notes the plaintiff. The event was scheduled for June 22, 2020 but was allegedly rescheduled to an earlier date, June 16, 2020. DesJardins says she called the company on two occasions, once in February and again in March of 2020, to request a refund for the tickets, but was denied.

“It is worth emphasizing that both of these refusals to cancel the contract and refund the Applicant were before COVID-19 essentially shut down most of North America and therefore was always the Defendants’ policy and unrelated to the pandemic,” states the complaint.

Since then, the concert has again been postponed, this time until June 21, 2021. The plaintiff contends that she is entitled to a refund for the rescheduled show under law. She also says that other consumers who purchased resold tickets through the defendant companies, but were denied refunds for cancelled or rescheduled shows are also due payment.

The defendants include Internet Referral Services, also known as Tickets-Center.com, StubHub Canada, StubHub, TicketMaster, TicketMaster Canada, Live Nation, Live Nation Canada, Vivid Seats, and TicketNetwork.

woman upset on the laptop and phone regarding the resale ticket refund class action lawsuit filed against group of online ticket distributors“The Defendants are all merchants operating websites, mobile applications and call centers where consumers – while physically in the province of Quebec – can purchase tickets on the secondary market (i.e. resale tickets) for events held in Quebec and elsewhere around the world,” states the proposed ticket refund class action lawsuit. “The Ticketmaster and Live Nation Defendants operate websites, mobile applications and call centers where consumers can purchase tickets both on the primary and secondary markets for events held both in the province of Quebec and elsewhere. For this group of Defendants, this action only concerns the sale of their ‘Fan-to-Fan Resale’ tickets (which relate to the resale of tickets between fans on the secondary market, but in which Ticketmaster hides the identity of the buyer and seller from each other and earns a significant commission from this sale).”

According to the proposed resale ticket refund class action lawsuit, those who purchase resale tickets enter into a contract with the companies facilitating the sale. When these consumers notify the resale companies, such as Live Nation, of their intent to cancel the contract, they are entitled to a refund of the ticket price under Quebec’s Consumer Protection Act, contends the resale ticket refund class action lawsuit.

Despite their obligations under Quebec law, the plaintiff says that the defendant companies who run these resale programs systematically deny refund requests. In fact, alleges the resale ticket refund class action lawsuit, some go as far as fighting chargeback requests made by consumers when they dispute the charge with their credit card company.

“Ticketmaster even refuses to let Quebec consumers dispute the charges on their credit cards and puts up a fight with the credit card companies so that Quebec consumers are denied their legal right to a chargeback pursuant to [the Consumer Protection Act],” alleges the complaint. “The Ticketmaster and Live Nation Defendants should be condemned to punitive damages for this clearly intentional and ill-spirited breach of the [Consumer Protection Act].”

The proposed resale ticket refund class action lawsuit seeks to represent those who purchased resold tickets through any of the defendants and who did not get a refund for rescheduled events between June 6, 2018 and now. The complaint indicates that there are thousands of potential Class Members who have been denied refunds through one of these ticket resale outlets.

The proposed resale ticket refund class action lawsuit is seeking damages on behalf of the proposed Class Members, as well as a court order nullifying the contracts between Class Members and the defendant companies.

    I purchased tickets prior to Covid for a concert in Portland, Or. Ticket-Center made everything look legitimate and I was not aware I was purchasing from a scalper. I paid over the amount legal for resale in my home state of Washington. I have screenshots of texts with their customer service refusing me a refund. The vendor is allowing refunds due to this concert just being rescheduled for the 4th or 5th time, but Ticket-Center is refusing to give my money back. Is there a way to join in this class action lawsuit from the U.S., since the company is based here? They are scam artists and I still don’t have the actual tickets either.

    ticket center is nothing but a joke I got tickets for nickelback in Aug. 2020 & they canceled ticket center refused a refund & said i’s have a store credit for future concerts. well 1 1/2 years later, they finally decided to refund me. when asked about my credit card used as they tried to refund it back to that card, I informed them it was compromised & I got a new one. they refused to take the new card information & said that money would go to my bank. a few weeks later, I still hadn’t gotten my refund & it was difficult to get a live person & when I did I was told that my account has a note stating in order to get my refund I would have to open up a PAY PAL account. I am still not able to get to a live person & I am constantly emailing them & I have NEVER gotten a response.

    Tickets-center.com is a fraud. Website is deceitful. Searched on Tanger Center Bob Dylan and this official looking website comes up first. Has venue pictures. Thought it was for the venue. I then purchased tickets from Tickets-Center. com. You think it is a legitimate seller. Person not reading terms and hitting purchase is their goal. Tickets were 2x price and I find out they sell something they don’t have. Will not refund. PayPal protection did nothing for me after claim denial and appeal denial. Early in the process, I have no hope of getting anything from what I am seeing from others. I am sure I am out 803 dollars for this Tickets-Center.com scam. At the Tanger Center venue in Freensboro NC the total for better seats is 447.00. A class action lawsuit is needed. Please I want to be included in a lawsuit. Punitive damages abd a change of consumer laws is sorely needed.

    tickets were purchased through ticket-center.com and what I got confirmation for what I was purchasing is not what I actually received. When I sent over the proof they just told me they don’t get involved with the 3rd party sales. Before that they kept telling me someone would call me back and never did after numerous attempts made out to the “company”. Not to mention you are charged 3 times the actual ticket sales so, if you are paying that much you should get what you pay for. I’ve read multiple responses saying that when you buy through this site once you get to the venue tickets won’t work because they are sold numerous times and scanned before you arrive to the venue

    I purchased tickets to The Weeknd at the beginning of 2020 for about 800 dollars the concert was then rescheduled twice then canceled in October. Ticket center (the WORST COMPANY I HAVE EVER DELT WITH) then sent me a store credit for the tickets I then emailed them asking for a cash refund for my tickets because the concert was canceled. They emailed me back and said they could not offer me a cash refund because of COVID. I then sent them their terms and conditions and a bunch of other stuff proving that that is non sense. I then gave up because they never got back to me and decided to use 200 dollars of my store credit for a Christmas gift. 3 days after I used 200 dollars of my 890 dollar store credit they emailed me and said that I am elegible for a full cash refund for my canceled concert tickets. I then emailed back saying yes I do want my cash refund and they replied saying I can’t get a refund because I used a little bit of the store credit. I emailed back and forth with them many times and called them many times and they can’t even address my concerns or answer my questions. Don’t ever buy through ticket master they steal your money and are so unethical

    Tickets-center is a FRAUD, tickets were purchased by a minor. I’m out of $567. 00 for tickets and they will not take your call, only re-route you to a prompt and block your number from calling back in. You only get a live person to buy tickets, Not to cancel orders. I have not received any tickets and the payment is still pending and they still will not cancel the order. How do I join the lawsuit.

    The weeknd concert is canceled. I asked for a refund a year ago and they said the only way I can get a refund is if the weeknd cancels. But now they changed their policy. It’s so unfair. And they have me a coupon which will expire and there’s no expect expire date. How can I join this lawsuit?

    I bought tickets for Hall &Oates in January of 2020. Then covid hit and it was rescheduled to August 26, 2021. That was 2 days ago. Got there and my ticket was Not valid. I’m out $1125.00. Ticket Center strikes again.

    I requested a refund for rescheduled concert several times and received no reply despite calling, emailing, etc. What recourse do I have ?

    Bought tickets for event in Austin that was eventually cancelled. Received a credit. I applied the credit on a new event and my order showed no balance owing. However, the entire amount for the new event was charged on my credit card. Been trying to contact someone at Ticket-Center and there has been no response. One big ripoff!!
