Several event ticket distributors, including Live Nation and Ticketmaster, are facing a proposed class action lawsuit filed by a Quebec woman who claims that the companies refused to refund ticket holders for rescheduled and canceled events.

Lead plaintiff, Janie DesJardins, alleges in her complaint that a number of ticket distributors who run “fan to fan resale” tickets and refuse refund requests for canceled or rescheduled events from those who purchase tickets through these programs violate the terms of their contracts with the purchasers. This practice allegedly affects tickets sold within the province of Quebec, as well as for events held around the world.

DesJardins says she purchased tickets to a Francis Cabrel concert in April of 2019 from the website ticketscenter.com. The tickets were sold through a resale program, notes the plaintiff. The event was scheduled for June 22, 2020 but was allegedly rescheduled to an earlier date, June 16, 2020. DesJardins says she called the company on two occasions, once in February and again in March of 2020, to request a refund for the tickets, but was denied.

“It is worth emphasizing that both of these refusals to cancel the contract and refund the Applicant were before COVID-19 essentially shut down most of North America and therefore was always the Defendants’ policy and unrelated to the pandemic,” states the complaint.

Since then, the concert has again been postponed, this time until June 21, 2021. The plaintiff contends that she is entitled to a refund for the rescheduled show under law. She also says that other consumers who purchased resold tickets through the defendant companies, but were denied refunds for cancelled or rescheduled shows are also due payment.

The defendants include Internet Referral Services, also known as Tickets-Center.com, StubHub Canada, StubHub, TicketMaster, TicketMaster Canada, Live Nation, Live Nation Canada, Vivid Seats, and TicketNetwork.

woman upset on the laptop and phone regarding the resale ticket refund class action lawsuit filed against group of online ticket distributors“The Defendants are all merchants operating websites, mobile applications and call centers where consumers – while physically in the province of Quebec – can purchase tickets on the secondary market (i.e. resale tickets) for events held in Quebec and elsewhere around the world,” states the proposed ticket refund class action lawsuit. “The Ticketmaster and Live Nation Defendants operate websites, mobile applications and call centers where consumers can purchase tickets both on the primary and secondary markets for events held both in the province of Quebec and elsewhere. For this group of Defendants, this action only concerns the sale of their ‘Fan-to-Fan Resale’ tickets (which relate to the resale of tickets between fans on the secondary market, but in which Ticketmaster hides the identity of the buyer and seller from each other and earns a significant commission from this sale).”

According to the proposed resale ticket refund class action lawsuit, those who purchase resale tickets enter into a contract with the companies facilitating the sale. When these consumers notify the resale companies, such as Live Nation, of their intent to cancel the contract, they are entitled to a refund of the ticket price under Quebec’s Consumer Protection Act, contends the resale ticket refund class action lawsuit.

Despite their obligations under Quebec law, the plaintiff says that the defendant companies who run these resale programs systematically deny refund requests. In fact, alleges the resale ticket refund class action lawsuit, some go as far as fighting chargeback requests made by consumers when they dispute the charge with their credit card company.

“Ticketmaster even refuses to let Quebec consumers dispute the charges on their credit cards and puts up a fight with the credit card companies so that Quebec consumers are denied their legal right to a chargeback pursuant to [the Consumer Protection Act],” alleges the complaint. “The Ticketmaster and Live Nation Defendants should be condemned to punitive damages for this clearly intentional and ill-spirited breach of the [Consumer Protection Act].”

The proposed resale ticket refund class action lawsuit seeks to represent those who purchased resold tickets through any of the defendants and who did not get a refund for rescheduled events between June 6, 2018 and now. The complaint indicates that there are thousands of potential Class Members who have been denied refunds through one of these ticket resale outlets.

The proposed resale ticket refund class action lawsuit is seeking damages on behalf of the proposed Class Members, as well as a court order nullifying the contracts between Class Members and the defendant companies.

    In December 2019 I purchased tickets to a LA Dodgers vs Colorado Rockies game for June 6th 2020. I contacted them many times starting in March about refunds or rescheduling, and literally today, July 7th, received an email that the event (which would have already occurred) was canceled and NO refund will be given even though when I purchased the tickets if an event was canceled I would be entitled to a refund.

    Already reaching out to an attorney for this…

    I purchased two tickets from Tickets-Center.com, totaling $279.50, to attend a New York Yankees spring training game at George M. Steinbrenner Field on Friday March 20, 2020. On March 12, 2020, Major League baseball canceled the remainder of spring training games. On March 13, 2020, I received an email message from Tickets-Center.com stating that the March 20 spring training game had been canceled and that I should allow 2 to 4 weeks for me to receive a refund. During the next 30 days I called Tickets-Center.com to inquire about the status of my refund. Both phone calls gave me the run around and asked me to be patient. Finally, on May 19, 2020 I received an email message from Tickets-Center.com to inform me that there would be no refund. Instead, I would be receiving a store credit, which has been worthless so far this year. I believe Tickets-Center.com should be obligated to stand behind their March 13, 2020 email and issue me a refund for the tickets I purchased in good faith.

    I bought four extremely expensive tickets to a rock concert in August, in Boston, on February 19th, 2020. TicketCenter.com “changed their policy” retroactively and are saying i have an “in store credit”. The “coupon” must be “used by the expiration date”. There is no “expiration date” on my coupon. At the time i bought the tickets, there was a 100% money back guarantee. I do not want an in store credit because they should honor their policy that was in place. I have filed a dispute with my credit card company for $1,319.00. After reading these comments, i don’t hold out great hope i will be refunded. I want in for the class action suit. Totally unacceptable!!!

    I had purchased 4 tickets for the NCAA wrestling finals. 3-4 days before the event was to take place, everything was cancelled shortly after due to the COVID outbreak. i received an email from “TICKETCENTER.COM” stating the event had been cancelled and to receive a refund, i needed to send the tickets back. once they received the tickets back, i would get my “refund” within 10-14 days. two months went by and nothing. my wife called ticketcenter and was advised they are working on getting our refund and to please allow 4-5 more days. eventually, we received yet another email stating that due to the outbreak, ticketcenter had to change their “refund policy”. now saying they would only offer me 110% of the value towards my next purchase. we contested their reply stating in the “1st email” that “if we send the tickets back immediately, we would get our refund”. still received zip. my wife called our credit card company and showed them the email from ticketcenter.com on our refund, showed them the receipt for the tickets being sent back to ticketcenter and when they received them back. got CC company to stop finance charges and remove charges for the money we spent on the tickets etc. thought things were going in our favor. nope. ticketmaster contacted our CC company and explained to them that they “gave” us a coupon voucher for “130%” of the value of the tickets. then ticketcenter sent us another email stating since the CC company sided in their favor, since they showed they sent us a “voucher coupon” and placed the full amount back to our credit card. finally, we just received an email again from ticketcenter.com advising they are now only giving us a “coupon” with only 100% value. yep and they did advise us, eventually, that they had to change their “refund policy” and that was only AFTER the covid outbreak. where can i sign up for the class action lawsuit?
    it seems one sided since “ticketcenter.com” demanded the tickets back in order to refund our money. assuming they needed the tickets back in order to get some if not all of their money back but then tells the customer, “we’ll just give you a coupon to use towards your next purchase”. they can get their money back but screw the consumer. we are currently trying to find a lawyer or law firm who will help us get our money back.

    Purchased 3 tickets in December of 2019 to Lion King at ASU Gammage theater In Tempe AZ for June 2020. Since the play is cancelled due to Covid they refuse to give me my money back. We are talking about $520. I filed a dispute with my credit card company Discover but they can’t or won’t return my money either. I may never want to want to go to a play and feel I deserve to get a full refund. Plays will not be happening for another year or more. I’ve tried emailing and calling to get a refund. I do not want store credit.

    I purchased 2 very expensive seats at the 2020 US Open Tennis in NY from Tickets-Center.com
    Same thing….purchased in Dec 2019, once Covid hit, I called numerous times to get a refund. They kept saying no, only if the event is cancelled, then they refund 100% of the purchase. Yesterday, I received an email say that they have changed their policy (which means they have broken the contract that was originally set), and are only offering a credit for (only) 1 year. This was a gift for my wife for Christmas. Unfortunately, we don’t see us going to any mass events for at least 2 years. This was a once in a lifetime event we planned…
    Still trying to contact them (which is very hard) and all I get is basically…”too bad, we changed our policy, we decided to move to a store credit”…
    How do I get on this Class Action Lawsuit?

    I just filed a complaint with the BBB about tickets-center.com. They canceled the show I have tickets for $535.50 and refuse to give a refund although the policy still on their website clearly states they refund for canceled shows. They tried to make their reason being their covid-19 hardship. What about our covid hardships?!?! ridiculous. I’m opening a dispute with my credit card today.

    I purchased two tickets to see Tony Bennett in San Francisco in August, 2020 from Tickets-Center. I just receive an email stating the concert was canceled. They’re refusing to refund which is NOT acceptable

    Purchased tickets to Minnesota Twins game scheduled for May 10, 2020.
    Game was cancelled. Requested refund from Tickets-Center.com. They refuse.
    I don’t want a credit for an event that was cancelled. I want my money back.

    I purchased 3 tickets for $660.95 through Ticket Center to the Erykah Badu concert in Cleveland, OH. The concert was originally for 3/21/20. It was postponed tbd and then rescheduled for 11/6/20. I was supposed to attend this concert with my 2 daughters because we were all available on 3/21/20 and this was a way to celebrate the completion of my master’s degree. In light of the pandemic, I can’t attend this concert on 11/6/20, becsuse I have health conditions that put me at high risk for not surviving the disease. I want a refund.
