Russell Security Wage Theft Class Action Settlement Overview:
- Who: Russell Security Inc. has agreed to a settlement with its current and former security guards.
- Why: The security guards had sued the company, claiming they were required to come to work 15 minutes early but weren’t paid for it.
- Where: Ontario, Canada
An Ontario security company has agreed to pay its current and former security guards $725,000 to settle claims it has underpaid them since 2017.
In a notice posted Nov. 17, lawyers for the plaintiffs said they had reached a settlement deal with Russell Security Inc., in a wage theft lawsuit filed against the company earlier this year.
The lawsuit, originally filed in March, alleged that Russell Security violated the Employment Standards Act and its contracts of employment by requiring security guards to show up for work at least fifteen minutes early, but failing to compensate them for this time.
The settlement will benefit all security guards employed by Russell Security in the Province of Ontario from Jan. 1, 2017 through Aug. 13, 2021, the Class notice says.
From the settlement amount, 25 percent will go to the lawyers, and $2,000 will go to the named plaintiff for his time advancing the case.
It is estimated that the claim will be approximately $362,402.92 after fees and costs are extracted, the lawyers said.
Payments to Class Members will average $151.00, less applicable statutory payroll deductions.
“Class members may receive more or less than this amount depending on their number of weeks worked in the Class during the Class Period,” the Class notice says.
The news comes as Workforce Inc and SOS Inc, two Sudbury-area staffing agencies, face a class action alleging they fail to legally compensate workers by requiring them to complete training without pay.
