StockX agreed to a $130,000 class action settlement to resolve claims it failed to protect consumers from a 2019 data breach.

The settlement benefits Canadians who registered for a StockX user account on the StockX website or mobile app before May 14, 2019.

StockX is an online vendor that sells sneakers, streetwear, collectibles, handbags, watches and more. On average, the website sees 30 million monthly visitors, according to the company’s website. StockX boasts $3.8 billion in gross merchandise value over its lifetime.

In 2019, StockX reportedly pushed out a password reset email to its users that cited “system updates” as the reason. TechCrunch later revealed this email was the company’s attempt to secure its systems following a data breach.

On May 14, 2019, an unauthorized third party allegedly gained access to sensitive account data. According to TechCrunch, the breach compromised over 6.8 million records, including information such as names, usernames, email addresses and other sensitive account data. This information was reportedly listed on the dark web for $300. 

StockX’s handling of the breach, and the amount of time it took to inform consumers, was called into question by cybersecurity professionals. Jake Williams, founder of Rendition Infosec, told TechCrunch the delay “robbed their users of the chance to evaluate their exposure.”

Canadian consumers impacted by the breach took legal action shortly after the company announced the issue. Plaintiffs in the StockX class action lawsuit claim StockX’s negligence resulted in the data breach and put consumers at risk for fraud and other issues. 

StockX has denied any wrongdoing, arguing no sensitive personal information or financial data was compromised in the breach. However, the company agreed to resolve these allegations with a $130,000 class action settlement.

Under the terms of the StockX class action settlement, each Class Member is eligible for an 18 month subscription to TransUnion credit monitoring services. Class Members may also submit a claim for out of pocket losses, costs and other unreimbursed expenses resulting from the data breach. This includes credit monitoring services, identity theft protection, insurance, credit reports or freezes, professional fees, bank fees, unauthorized charges and other documented costs.

The deadline for exclusion was July 4, 2022. 

The deadline for objection was June 14, 2022. 

The settlement was approved by the court on July 11, 2022.

In order to benefit from the StockX class action settlement, Class Members must submit a valid claim form by Dec. 7, 2022.
