UPDATE:

  • The Court approved this settlement Nov. 30, 2021.

Quebec consumers who subscribed to certain Bell FIBE services from Bell Canada may be eligible to benefit from a $2 million settlement resolving claims that the network wasn’t composed entirely of fibre optics.

The Class includes all consumers within the meaning of Quebec’s Consumer Protection Act, residing in Quebec, who subscribed to FIBE TV and/or FIBE Internet offered by Bell Canada between May 1, 2012, and March 30, 2017, and who were not connected to a 100 percent fibre optic network or were not connected to a network entirely composed of fibre optics.

The plaintiff’s class action lawsuit alleged Bell Canada misled consumers through its use of the terms “Fibe” and “fibre optics” when offering services that actually were composed of both fibre optics and copper, violating Quebec’s Consumer Protection Act.

Bell Canada denies any allegations of wrongdoing, but has agreed to the settlement.

The settlement fund will be distributed equally among Class Members as a one-time price reduction on their monthly invoice after attorneys’ fees and other costs have been deducted from the fund. This credit will be applied within five months of the settlement’s final approval.

The credit of about $8, plus tax, will be applied to the accounts of Class Members who meet all of the following criteria:

  • They subscribed to Bell’s FIBE™ Internet or television services between May 1, 2012, and March 30, 2017
  • They were connected to Bell’s network through a fibre-to-the-neighbourhood connection (FTTN)
  • They remain subscribed to Bell’s FIBE™ Internet or TV services as of the distribution date

Each Class Member’s price reduction will be the same regardless of the number of services they are subscribed to or the number of subscribers on the account.

Those who do not meet the above criteria are not entitled to compensation.

A final approval hearing in the Bell Fibe settlement is scheduled for Nov. 24, 2021.

The deadline to opt out of the settlement is Sept. 13, 2021, and the deadline to file an objection is Nov. 5, 2021.
