Opioid Epidemic Class Action Lawsuit Overview:
- Who: A man who says he was over prescribed OxyContin lodged a class action lawsuit against opioid supplier McKinsey & Company.
- Why: The plaintiff claims McKinsey has helped fuel an opioid epidemic in Canada by misinforming physicians and targeting doctors prone to oversupplying patients with the addictive drugs.
- Where: The class action lawsuit is pending in the Ontario Superior Court of Justice.
Opioid supplier and global consulting firm McKinsey & Company has been helping fuel an epidemic currently affecting Canada, a new class action lawsuit alleges.
Plaintiff Jordan Francis Charlie claims McKinsey consulted opioid manufacturers on how to misinform physicians and get their addictive painkillers into the hands of the doctors prone to over-prescribing.
Charlie wants to represent a Class of Canadian residents who were prescribed and became addicted to opioids since 2002.
The plaintiff says he became addicted to opioids, lost his job, and lost custody of his kids after he was prescribed OxyContin in 2007 following a back injury suffered while working in forestry.
Opioid Manufacturer Faces Lawsuits, Bankruptcy in US
McKinsey reached a settlement worth around $573 million earlier this year with attorneys general from several US states over allegations the company helped push OxyContin offered by Purdue Pharma.
Purdue Pharma has since filed for bankruptcy protection, according to The New York Times.
Charlie claims that, in addition to helping opioid manufacturers nudge doctors to push their drugs on the Canadian population, McKinsey also helped convince manufacturers to look the other way as their painkillers fell in the hands of black market sellers.
Canada is currently the world’s second largest consumer of opioids — behind only the US — and experienced 21,174 opioid-attributed deaths between January 2016 and December 2020, according to the class action lawsuit.
Charlie claims McKinsey is guilty of negligence, breach of consumer protection statutes, conspiracy, unjust enrichment, and healthcare costs.
