IsaLean Weight Loss Lawsuit Overview:
- Who: A B.C. woman filed a lawsuit against Isagenix International.
- Why: Isagenix’s IsaLean line of weight loss products allegedly caused her to suffer chronic pain, an abnormal heart rhythm and other adverse health effects.
- Where: The Isagenix lawsuit was filed in the B.C. Supreme Court.
Isagenix International LLC and Isagenix Canada ULC are facing a lawsuit filed by a B.C. woman who says she suffered chronic pain, an abnormal heart rhythm and other issues after using the companies’ IsaLean weight loss products.
Plaintiff Chera Harris says she had been involved with Isagenix for years, purchasing products and selling them for a commission under the multilevel marketing structure.
In addition to selling Isagenix products, she also personally used IsaLean meal replacement products, according to the lawsuit. In October 2020, Health Canada recalled IsaLean products due to “over-fortification of vitamins.”
Health Canada issued a recall notice in November 2020 for 24 Isagenix products due to “reported illnesses” linked to the products. No further detail was provided in the Isagenix recall notice.
IsaLean Products Caused Adverse Health Effects, Isagenix Lawsuit Alleges
Harris experienced “a significant decrease in her overall health as a result of a chronic overdose of vitamins and minerals,” the IsaLean lawsuit alleges.
Not only did she suffer chronic pain and an abnormal heart rhythm, but Harris also allegedly experienced anxiety, depression, and sleeplessness as a result of using the IsaLean products.
The lawsuit says the Isagenix defendants were negligent in the design, manufacturing, distribution and marketing of the weight loss products.
“Resellers and consumers are entirely reliant on the defendants to ensure the quality of the defendants’ products,” according to the IsaLean lawsuit. “The extent of the unsafe levels of vitamins and minerals in the products was not known and could not have been known by the plaintiff.”
Harris is seeking damages for pain, suffering and loss of enjoyment of her life.
Isagenix has reportedly re-released its IsaLean products with “safe levels of vitamins and minerals.”
IsaLean Lawsuit Should be Resolved in Arbitration, Isagenix Says
Isagenix has asked the B.C. Supreme Court for a stay of the proceedings because Harris is bound by an arbitration clause in her contract as a reseller, which requires claims to be resolved through confidential arbitration in Arizona.
Justice Ward Branch disagreed that Harris was bound by the arbitration clause because she was pursuing the IsaLean lawsuit as a consumer and not as a seller.
“A person may obviously be a supplier in one consumer transaction but not in another,” Branch wrote in a Feb. 18 decision.
