The City of Edmonton is the target of a $565 million lawsuit over the temporary mandatory mask bylaw. According to the lawsuit, the temporary mask law is a “nuisance” and a hazard to public health. The mandatory mask lawsuit also claims that the law has increased a flurry of used masks on the streets, potentially leading to a health hazard.

Glenn Miller filed the lawsuit in the Alberta Court of Queen’s Bench, but reportedly says he will end the legal action if the city council overturns the mask law within ten days. If the city does not dismantle the mask law, he will continue the legal proceedings seeking $565 million. The mandatory mask lawsuit was spawned over Glenn’s frustration with used masks being thrown onto the ground. He reportedly says every time he walks outside, he sees used masks on the ground.

“By the discarding of face masks and with the city knowing or that it should have known that it is unable to control the actions of the people, the city has created a public health hazard for me and others. Everywhere I go, when I walk to places like Superstore or Southgate mall, masks are all over the place. It’s unsanitary.”

On Aug. 1, the mandatory mask rule was established to help slow the spread of the coronavirus. The mask law is mandatory for indoor places including restaurants, stores, and other facilities.

The mandatory mask lawsuit claims that since the start of the law, there are more littered masks on the ground. Lori Yanish, a spokeswoman for the city, reportedly confirms there has been an increase in littered masks. The city is planning to undertake the mask problem by creating litter kits. The litter kits will include a trash grabber, garbage bags, and gloves. The litter kits will include a public notice for businesses to display.

According to the Edmonton Journal, Ms. Yanish wrote the following in an email to Postmedia: “The city is seeing an increase in discarded mask litter as more masks are being worn. We remind citizens to properly dispose of masks, face coverings and other personal protective equipment — these items should be put in a garbage bin. We are concerned about litter and are doing additional communications work to address this issue.” 

After the mandatory mask law was established, no tickets were given for littering or not disposing of used masks properly. Citizens have reportedly been compliantly wearing masks with only 800 verbal warnings given to citizens about wearing a mask in public places. Reportedly, 97.5% of people have been following the mask law in indoor places and 92% have followed the mask law on public transportation.Woman putting mask on girl regarding the mandatory mask lawsuit

Navigating the mask laws have been a source of frustration for many reasons. When the mask bylaw was put into place, there were mask exemption cards provided for those who cannot wear masks for health reasons. The exemption card program ended two weeks ago after the program was being abused by citizens who do not have a reason for the exemption. The exemption card program was halted after only four days. Next week, the Edmonton city council is planning to discuss the next steps for the program. 

The mandatory mask lawsuit is not the only legal action that has been taken in response to the measures implemented in Canada to prevent the spread of the novel coronavirus. In July, Vaccine Choice Canada filed an $11 million lawsuit against the Canadian government arguing the COVID-19 regulations, including requiring people to wear masks, violate Canada’s Charter of Rights and Freedoms. The lawsuit accounts devastating stories of people who are traumatized by wearing masks.

Many say that mandatory face masks are unconstitutional. The Canadian Constitution Foundation (CCF) has also raised concerns about mandatory masks in an open letter, stating that mandatory masks impede on wearers’ bodily integrity by covering the face. Many people have breathing problems or phobias regarding not being able to breathe. The masks can trigger phobias or traumas. Many believe that mandatory masks are infringing on basic human rights. 

Now, the mandatory mask law is bringing up new issues about hazardous litter. The result of the legal action remains to be seen.

    Its true we are in a pandemic. I cant seem to understand why people are so selfish about NOT wearing masks. I have seen a dozen people sick, 2 of which are in ICU. One passed away.
    Because selfish freedom civil liverties fighters simply dont want to wear a mask for a few more months! If i get covid and i can see exactly whom i got it from i will personnally sue for everything you own.
    I wear a mask, i have asthma and severe allergies, yes a bit unconfortable. Certainly not enough for me to selfishly threaten someones life. When times are hard we see exactly what peoples true colors are.
    I see people coughing – no mask and spreading germs with no thought but for yourself. Well i have s solution…
    For all the people whom figure masks are a control issue, or the virus isnt so bad.. go volunteer at the hospitals!!!
    Your invincible, and you can save masks and save people as well as yourself. I bet a million thou you wouldnt cause your just to damn rightious!!!!

      Here’s a thought….. if you want wear a mask, then put one on. Answer me this, before all those posters telling you to ‘wash your hands’ sprung up, logic would suggest you didn’t?
      When politicians play doctor and doctors play politician, then the common individual is left to make senseless basis for arguments. When you depend on a government to makes ‘rules’ on your basic movement as you go about your day, you have truly sunk to the the level of the ‘idiots’ that need an instruction manual to get from one morning to the next

    If this mask dictatorship continues for much longer things will only get worse as every minute ticks by. The majority of people are stressed out and most do their best to stay away from any place where they are forced to wear a mask, or are forced to conform to any other mandated injustice.

    I would think it is easy to say that most people never thought they would ever be forced into something as ludicrous as this present time political tyranny. We have actually went backwards in time, we seem to be reverting to an age when there were unjust monarchs. Our freedoms are being taken away by those who have no right to do so. The people fought those oppressive rulers then and if it comes down to it, the people will rise up against this tyranny again.

    This cannot and will not continue, this is hurting the lives of millions of people… destroying lives, families, businesses, the psychological well being of humankind all over the world. My Father please bring us your light and release us from this darkness that is being forced upon us.

    Can I please be apart of this lawsuit? I cannot breathe in this mask, have anxiety all day at work, and no option to take it off or I can’t pay my bills!

    I want to know why the exemption exists within the mask bylaw but it is not enforced. The whole bylaw should be enforced, not just giving tickets to those who don’t wear a mask, but also giving tickets to companies, (eg. malls) who don’t follow the exemptions. It feels like the exemption was put in only to cover the City’s butt against lawsuits. The exemption is: ” If you have mental or physical concerns or limitations, or any other protected ground under the Alberta Human Rights Act, then you do not have to wear a mask or face covering. You don’t need to show anything around being exempt, however you may self-identify if you are exempt”
    I have been refused medical help and been also kicked out of places, even though I have a doctor’s note exempting me from wearing a mask for medical reasons. I end up compromising and wearing a visor even though that also adds to the severe PTSD of being kidnapped and forced with a covering on my face. Today the X-ray place wouldn’t even allow a visor.
    Something has to be done. I even heard that children are being forced to wear masks in school with no exemption being allowed. It is happening everywhere…

    I am so relieved to see such thoughtful and caring responses to this issue. I am 81 and wearing a mask makes me so ill and uncomfortable that I am avoiding shopping as much as possible. I am disgusted by the mask litter which a health hazard to us all especially to children and animals. I am grateful to Mr. Miller for launching legal action against the city. I consider this bylaw to be in violation of my rights and personal safety. I have written to both the mayor and my council member but neither of them have bothered to respond. I will certainly looking for more aware and intelligent candidates for these positions come election time. Many thanks for giving me a space speak.

    Myself and a co-worker regularly go to City Centre Mall for lunch. The mall has become a graveyard of failed businesses, therefore we choose to spend our money at the food court in hope that this helps them in some small way. My co-worker cannot wear a mask due to medical reasons and she walks with a cane as she is waiting for a double hip replacement. We walk there almost daily at considerable pain to her. Yesterday halfway through the mall we were kicked out because she could not wear a mask. They would hear nothing of it and security told us the management company said they didn’t care if there is a reason for the person not wearing a mask, they have to be kicked out. It is time for people to fight this unlawful, unconstitutional mask mandate and make the City pay.

    I agree masks are not healthy nor proven effective in preventing the spread of disease. If people chose to wear them that’s fine but should never be mandatory. Discarding them on the ground is more of a hazard. Children can pick them up and use or play with them.

    This entire corona event reeks of desperation, confusion, and miscalculation on the part of the authorities. They lacked the EMOTIONAL INTELLIGENCE to foresee that the public, in general, would never accept such an unnatural behaviour (not to mention social-distancing). My close-knit neighbourhood is a case-in-point. The hazardous litter will never disappear as long as this mandate remains in force. Period.

    I’ll go back to the shops when mask/social-distancing laws are irrevocably banned, and not before. Let the Class Actions roll!
