A group of ombudsmen from across Canada are warning premiers and other officials of the legal risks associated with requiring people to show vaccine passports, or other proof of vaccination, to access services.
On May 26, the Canadian Council of Parliamentary Ombudsman (CCPO) released a guide Wednesday that outlines how provincial and territorial governments mitigate human-rights complaints and legal challenges if they plan to institute vaccine passports, The Globe and Mail reports.
The guide is based on creating fair, transparent rules and says that new laws or policies should be made to give clear guidance and those laws should be publicly available with a built in review and appeal process. New rules should also accommodate those who can’t get vaccinated for medical reasons, the guide says.
CCPO President and Ombudsman for Nova Scotia Bill Smith told The Globe and Mail that officials did not want to inadvertently affect somebody’s right or access to a government provided service due to lacking a vaccine passport.
“You could see how something as simple as taking a driving test might demand a vaccine certificate, or accessing a recreational arena,” he said.
Recently, Canada’s federal, provincial and territorial privacy commissioners issued a similar joint statement urging caution to politicians planning to bring in vaccine passports.
Smith told The Globe and Mail that until now provinces have only been discussing creating vaccine passport programs, and although some provinces are considering instituting the passports, others have already come out rejecting them.
Alberta Premier Jason Kenney has said his government won’t require or provide vaccine passports, saying that anyone in Alberta who needed proof of vaccination to travel internationally could use the documentation they received when they got their vaccine.
British Columbia’s Provincial Health Officer Bonnie Henry said that she does not want proof of vaccination to be required on Canada’s West Coast, and that she had support from the premier.
“This virus has shown us that there are inequities in our society that have been exacerbated by this pandemic, and there is no way that we will recommend inequities be increased by use of things like vaccine passports for services [or] for public access here in British Columbia,” she said.
However, the Ontario government discussed issuing vaccine “immunity certificates,” The Globe and Mail reports, but Premier Doug Ford’s head of communications has said that the government is examining all options and has not decided on creating such a system.
Quebec sends residents electronic proof of vaccination, but the provincial government has said it is still deciding on issuing vaccine passports, The Globe and Mail reports.
As the pace of vaccination picks up across Canada and the globe, there are increasing discussions around the implications of mandatory vaccinations. With some employers now wanting to make vaccinations a stipulation for employment, the impasse between individuals that don’t want a vaccine, and employers that want them vaccinated has grown into a controversy about whether employers can mandate vaccination for on-site workers.

I have managed to squeek through without having to get any vaccine jabs but not without great cost to my personal life and mental well being ive been ostracised treated like second class called every name in the book shamed belittled looked at like some idiot conspiracy theorist its cost me 30 year long friendships and caused me to become an unwelcomed outcast among what little family i had left ive spent the last 2 years plus alone and been increasingly cut off from all resources and life lines i used to get by on my own my hours at work are slowly being reduced as more ppl refuse to work with me or allow me on their jobs my mental health has taken a nose dive being rejected by not only society the government denied the right to leisure or fun and left with little option but to lay in bed and watch tv any time other than when im working and all this has been done to me because of the fears from ppl who eagerly lined up for the vaccines so that they could be protected from the DEADLY corona virus as soon as possible and despite being protected by those vaccines feel its necessary to also deny me the right to breath the same air as them because somehow this would increase their risk of catching the virus they are now protected from but not me …..how does that make any sense at all if anyone was applying common sense or rational thought to this at all you would think if anyone was more at risk of catching and having an adverse reaction to exposure of the virus would be the ppl who are not vaccinated/protected from it and would then dictate that it should be the vaccinated who should be denied access to everything because of the very real truth that they are the larger risk of harm to the unvaxxed than the unvaxxed are to them which clearly shows us that it has nothing to do with rational thought or anyones best interest or protection but that they are just creating uncomfortable unreasonable and intentionally stoking fear of others to exert as much pressure and ridicule as possible to force those who resist the vaccine to have no choice but to get the vaccine by making life for anyone whos not completely miserable lonely and cut off from society so sign me up for the class action lawsuit or some guidance as to what steps i have to take to join the class would be greatly appreciated
Im with you on this. There are better ways to mitigate not only the virus, but the mental health effects of this labs mix and the restrictions the government is imposing to push their mandates. People are literally killing themselves, becoming anxious, depressed, suicidal, fleeing the country because government refuses to take a common sense approach to current issues. It’s sickening and they should be tried at the highest courts for crimes against humanity.

so frustrated, angry , and sad
I had adverse reactions 6 days in hospital after the firs jab, currently on sick live. Doctor don’t want to give me exemption and my employer will terminate me on December 13. If I take 2 jab it is suicidal mission or loose my only income. I was working through the whole pandemic at the front line. I would like to join class action against all levels of government.
I too am in the same position, deadline on the 26th of Nov. My employer was fine with me working through the entire pandemic but now is forcing me to get the vax!! totally unfair!
This garbage has gone on long enough. I am no longer allowed to eat out or volunteer as I will never get the passport as the shot is proven by science to be deadly! See Dr. Bryam Bridle and Dr. Peter McCaullough. There are many specialities out there that are far better educated about this than our pathetic government officials. Why is the vaccine pass port based on consumer belief that they are safe ? So a false belief should stop others from traveling. YOu can carry the virus even if you’re vaccinated read the cdc statistics .

No to mandatory vaccines and to vaccine passports. As of October 4th, in Nova Scotia, you must show proof of the jab as a requirement to participate in some aspects of society like eating at a restaurant or watching hockey at the arena. I do not consent!
