Vita Health Products Inc. and Sisu Inc. have agreed to a $450,000 class action settlement resolving claims that some products were incorrectly labelled as containing glucosamine.

The defendants allegedly became unjustly enriched, engaged in negligent misrepresentation, and violated the Competition Act and provincial consumer protection legislation.

Vita Health Products manufactures, markets, and distributes nutritional supplements throughout Canada, according to the company’s website.

Similarly, Sisu makes natural health products using non-GMO formulations, its website says.

The settling defendants deny all allegations that their conduct was unlawful.

Other defendants are involved in the class action lawsuit but are not part of this settlement agreement.

The Class involved in the glucosamine sulfate settlement includes anyone in Canada who purchased certain products between May 6, 2004, and June 1, 2021, for household, family, or personal use.

The products covered by this settlement include products labeled as containing the following:

  • Glucosamine sulfate
  • Glucosamine sulfate potassium chloride
  • Glucosamine sulfate KCL
  • Glucosamine sulfate • KCL

The settlement fund will be held in an interest-bearing trust account until the Court decides how the funds will be distributed.

The funds may be distributed to Class Members or charitable organizations, used to pay for litigation costs, or any combination of these.

If the money is to be distributed to the Class, the Court will determine the manner in which Class Members may apply for a payment.

In addition to the potential monetary relief, the settling defendants also have agreed to relabel products currently labeled as glucosamine sulfate products so that the font label references “glucosamine” and one or more brand names; the back label will refer to “glucosamine hydrochloride” or other commonly accepted chemical or proper names approved by regulators.

The settlement must still be approved by the Court in British Columbia.

An approval hearing is scheduled for June 1, 2021.

    I have been using Jamieson Collagen Glucosamine complex for about five years. I had a torn meniscus. It totally helped. Is the problem with all brands, with just the glucosamine supplement or with the combinations as well?
