Quebec consumers who allegedly contracted hepatitis A from several recalled products may be eligible to benefit from a $775,000 class action settlement with supermarket company Groupe Adonis.
The Class includes anyone in Quebec who contracted hepatitis A while consuming contaminated recalled products, have been vaccinated against hepatitis A since consuming the recalled products, purchased the recalled products between Jan. 1 and April 20, 2018, or are successors, beneficiaries, heirs, family members, or dependents burden of an individual who contracted hepatitis A by consuming the recalled products.
The recalled products relevant to the Groupe Adonis hepatitis A settlement are:
- Frozen strawberries from Egypt, Montana brand, 1 kg format, sold in all establishments of the Adonis banner between Jan. 15, 2018, and April 20, 2018, and bearing code 6222000401487
- “Adonis Juice” bottled with strawberries and bananas, 1 L and 500 ml formats, sold in all Adonis-branded establishments between Jan. 15, 2018, and April 13, 2018
- Bottled “Strawberry Sweetness” smoothies, 1 L and 500 ml formats, sold in all Adonis-branded establishments from Jan. 15, 2018, to April 13, 2018
- The “Adonis”, “Monsieur Twister”, and “Saveur d’été” cocktails served in plastic glasses, large and medium sizes, sold in all Adonis-branded establishments between Jan. 15, 2018, and April 13, 2018
Hepatitis A can cause symptoms such as fever, loss of appetite, upset stomach, and more.
The plaintiff in a class action lawsuit alleged Groupe Adonis was negligent in its manufacturing and distributing the recalled products.
Groupe Adonis maintains it has not done anything wrong, and the Court has not ruled in either party’s favor.
Eligible Class Members will be paid for claims arising from the sale of the recalled products, including for economic losses, damages for the need to be vaccinated, and bodily injury.
The settlement funds will be paid to four claimant categories:
- Category 1: Those who purchased products recalled and who suffered economic loss (i.e., claims for reimbursement of purchase price). These claims will pay out an amount equal to the purchase price, if proof of purchase is provided, or up to $10 without proof of purchase.
- Category 2: Those who consumed the recalled products and had to be vaccinated against hepatitis A as a result. These claimants who provide proof of vaccination dated, at most, three months before or after the recall date will receive $150, plus reimbursement for the cost of such a vaccination if proof of payment is provided.
- Category 3: Class Members who contracted hepatitis A following their consumption of a recalled product
- Category 4: Family members of Class Members who contracted hepatitis A following their consumption of the products that were recalled
Damages for bodily injury claims will range between $250 and $20,000, plus additional compensation for any time spent in the hospital. A table of damages is available here as Annex A.
More details on the requirements for each category are available on the claim form.
Final payment amounts may be adjusted depending on the number of valid claims filed.
The Court approved the Groupe Adonis hepatitis A settlement June 23, 2021.
