The Quebec Superior Court has certified a class action lawsuit lodged against Hertz and other major car rental companies claiming they refuse to rent to drivers under the age of 25.  

Class Members in the newly-certified class action lawsuit include drivers between the ages of 16 and 24 who entered into a car rental agreement between Aug. 16, 2016 and the present.  

The class action lawsuit alleges that practices by Hertz, as well as Enterprise, Alamo, National, Avis, Discount, and Budget Auto, that force young drivers to pay higher fees or even prevent them from renting a vehicle at all, violate Canada’s Consumer Protection Act. The car rental companies illegally discriminate against young drivers, even those who carry insurance, claims the lawsuit.  

Indeed, most car rental contracts require drivers to be at least 25 years of age, according to Driving Canada. Rental companies who permit drivers between the ages of 16 and 24 usually impose extra fees as well.  

“Younger drivers were already having to pay more to insure their vehicles because of their age,” a lawyer representing the Class Members pointed out to reporters in a news release. The class action lawsuit claims that “the fees imposed by lessors penalize them a second time.” 

Indeed, younger drivers often pay more for car insurance based on their age, but the class action lawsuit says this practice should be prohibited when it comes to renting a vehicle from Hertz or other major company.  

The class action lawsuit is seeking damages on behalf of Class Members for these allegedly discriminatory practices by Hertz and other car rental agencies.
